    hi everyone

    I m an MBA(major:general mba)student in a university in texas. I have an bachelors of engineeing (electrical & electronics)from india. I have found an desi employer who is ready to train me in SAP (FICO)functional and than place me on projects to diffeent companies. Since i m graduating in august 2008 ,At first i have to work for him on OPT and than in apil 2009 my employer will sponcer my h1 visa.

    Now my question is....
    1) can i work in SAP FICO functional , when i m on my opt?(opt means i have to work in a job directly related to my major field of study and i guess SAP is not related to my field major field of study)

    2)will i have problems getting a h1b visa? (since General MBA and SAP are completely different fields )

    Any comments or suggestions will be appreciated.

    Mine got approved in about 2 months time. My labor certificate reached the lawyer who passed it on to my employer.

    I did a big mistake of not asking for a copy and again when I received it while filing I140 - did not make a copy again.

    Please save a copy for yourself - it helps a lot while switching jobs during AC21.

    Looks like there are 27 co-sponsors for HR 5882 and 7 of those joined this month. That is a good news I guess.

    i transferred from one dept to another. the next dept filed for a H1B amend after 4 months. The lawyers filled in my G325 with the earlier, start date (and not the later filing date).

    Am I in trouble?

    not possible. Many documents in first 2 phases are companies. Its is illegal if employee is involved Labor process in any way.

    Find someone who will file H1 for you next year and apply for GC....

    Hello Gurus,
    I have got my wife passport stamped(H4) until Oct'09 based on my previous H1. I have changed company and got new I-797 for both of us valid till Apr'2010. During her recent visit to India and return to USA, at the port of entry she was issued I-94 till Oct'2009 eventhough her I-797 form my new employer is valid till Feb'2010.

    I don't want to ask my wife to cross the broder (@Mexico or @Canada) for the sake of renewing her I-94. I am wondering if I can apply with USCIS for her extension of I-94 till April'2010 for which she has I-797 to support it.

    I heard that it is pretty easy there. 2 years back One of my friend got 10 year multiple entry visa from singapore. He has told me that there was no queue in american consulate in Singapore.

    Hi All,

    I need some advice from gurus.

    1. My company filed for my labor and then EB2-140 with March 2007 PD.
    2. A labor became available with EB3 specs and September 2002 priority date.
    3. I wanted to capture that but my company lawyer said no stick with EB2.
    4. Just before July 07 fiasco, when labor-sub was getting eliminated, I asked and applied for labor-sub I140 with Eb3 and September 02 PD.
    5. Filed I485 with EB3 140's copy and receipt number.
    6. Just recently both of the 140s got approved.
    7. Eb3 PD is not current but if I could use the EB3 pd to put into EB2, I could be current. Is there a way or am I day dreaming?

    Hello,

    I am a US Citizen who applied through I-130 form for my married daughter since 2001. She and her husband came here with a tourist visa in 2003 and they overstayed it for a period of 6 years. In the meatime, they had 2 americam kids. They are still in the USA.

    I am starting to receiving document from NVC to pay $70 for Affidavit of Support for their cases. I would like to know if an Adjustment of Status can be made for them here in the USA as the immigration does not know where they are right now. I presumed also that they can't return back to their country of origin cause they've been here for so long that they could get caught and get penalized. They have never been employed but received support from the family members and their kids received welfare aids.

    What can be done if I want to Adjust their status here? Thank you already for your answers.

    First, submit a change of address form on USCIS web site for you and your wife. Have all of your receipts ready - after the general change of address form you will need to submit one for every petition (!) you have pending.

    After you receive all of the change of address confirmations from USCIS (takes about a week), make an InfoPass appointment or juggle the call center system into transferring to your service center to talk to an immigration officer - please make sure all of your addresses got changed.

    Don't forget to foreward mail at the post office.

    I applied under EB2-NIW on July 28, 2007. Under the concurrent filing allowed at that time, I submitted NIW, I-140, I485, and EAD applications for me and my wife. I have changed jobs, and joined a new company last week.

    Since I filed a self-petition, my application should not be directly affected by this move. However what do I need to do to inform uscis about this change, so that my receipts/EAD etc. do not go to the wrong place, or worse, get returned by the post office.

    Please advice. Any additional info/experience would be great.

    A word of warning: If for any reason the US Consul in Canada denies your visa application, you will not be permitted to return to the US until you go to India and get an H visa.

    Many threads here are on this, you've got to look for it and read. You've asked a question that has been asked and answered many times. That is why nobody has answered your questions.

    In brief, you can use AP to come back, and work with H1B for the company who filed your H1B petition, and you can extend or transfer your H1B as well. You can also work on EAD for anyone you want, but you cannot come back to H1B.

    There is more on other threads that will make you feel more positive about these answers, and helpful info on traval with AP.
