Folks,
I am not getting my hopes too high about the EB-485 processing dates--either for the TSC or the NSC. Correct me if I am wrong...but I think that this huge progress in the EB 485 processing dates can be attributed to the fact that EB2 (India) is retrogressed and even unavailable (currently) and EB 3 (India) is also regtrogressed, and of course, not to mention China. So, perhaps both the service centers are processing EB 485's for ROW--and thus this quite impressive forward move.
If at some point India's EB2 and 3 priority dates move by a great leap beyond what it is now (ie., if the centers start processing the July 2007 VB submissions of EB2 and 3) , then should not we expect that the processing dates of the two centers be back-logged again and thus retrogressed?

What an efficiency and consistency ? And we think Indian govt. offices are slow and inefficient. This is far worse than any other thing that I have heard of. The irony of it is that it is happening in US.

50,000 visas were recaptured for Schedule A occupations - nurses and physical therapists. That is why both India and Philippines got more numbers in FY 2006.
The # for 2006 excludes schedule A recapture for nurses etc. Here is the breakdown
EB1 - 3K
EB2 - 3.7k
EB3 - 3.1K
EB4 - 0.6K
EB5 - 0.02K
Total EB - 10.7K
Schedule A - 6.7K

All brushes are not created equal. The arctic butterfly that Stephen mentioned builds up a static charge that causes the particles to cling to the brush. A brush without a charge just moves the particles around and leaves them in the cavity if not thoroughly blown out. More on that here (http://www.visibledust.com/index.php).
I've not had good results from eclipse, and you cannot take it on an airplane. I've had very good results with the combination of a blower and arctic butterfly. For extremely stubborn dirt, I've had good luck with a lens pen. More on that here (http://www.lenspen.com/).

I am sorry to hear about your situation.
Your attorney may be completly wrong about the labor substitution. The USCIS has passed new rule, The labor will be voided once its passed 180days after approval. So the approved labors from your company has no value.
Did you try utilizing AC21 as your 140 approved and the 180days crossed?
Again I am not a lawyer, please talk to experienced attorneys.

Attorney has made this mistake since many labors were filed at that time and the labor that they have used for me has been approved . Do you guys whatever the attorney is suggesting is going to work? Please let me know i haven't got an RFE yet..

I my PD is July 2003 EB3 (India).
My I140 was approved in 2006 and had applied for 485, EAD, A/P in July 2007 like most of you. Yesterday LUD on my approved I140 and 485, EAD, A/P applications in USCIS changed after months. But now my approved I140 status has changed to

I have NOT done any labor substitution or anything like that.
As usually our corporate lawyer and HR were useless and think this is just some system issue at USCIS. Did anyone else see this before? I was looking for other threads but couldn't find anyone else having similar issues.
Immigration gurus - any suggestions/comments? Is this normal?

Hi desi9333, let me answer your question in general and note that this is not a speculation on the OP's case. A common reason for L1 denial could be that the USCIS determines that the petitioner isn't really in a 'specialty' occupation. For example, if his job description mentions java programmer, then he is more likely to get denied since we know there is a surplus of java programmers in this country (US citizens, LPRs and our favorite H1Bs). Since I was on an L1 visa, I know the purpose was really 'specialty' occupation which means you need to be an expert on something that's not easily available in the U.S.

L1 is intracompany transfer. Means you worked for a foriegn company in some other country and you are expert in their technology(in-house) or products. And they require you at their office in US. That's where they should apply for L1 Visa.

I will be filing with the company lawyers. I guess the company is wiling to hold me only to the minimum requirement of 90 days after becoming full time, before filing for GC because I've been working for them since last year. My company liaison between the employees and the company lawyers is the one who told me to just buzz him when I am ready after the 90 days full time and he will give the lawyers the green light to go ahead with GC.

So nurses will get priority in the limited quota of these countries and once the quota is finished, they will go on to take the 61K quota. This will hurt regular EB3 people as their quota is exhausted. This is one of the many reasons why dates for india are so far backlogged.
If government really wants to help nurses then they should probably give them extra H1B visas or J1 viisas or something. They should not be giving them direct greencards meant for regular EB3 folks and denying EB3 folks waiting in line for a long time.
This is happening because of the strong nurses lobby and bodyshoppers who bring in the nurses directly on greencards.

My AP was mailed by USCIS in January and I never received it. Called USCIS customer service, they said I need to apply again by paying $305 again. Called up USPS and they cannot find it, USPS said they will be sending me apology letter.
Did any one lost AP in mail, did any of you refile again.
I had a similar situation. The website showed that the case was approved. After waiting for few weeks had my lawyer contact USCIS. They said to wait another week and if it does not arrive then they will issue a duplicate one. The very next day, the lawyer fedexed me the AP papers saying they arrived. Now, i am not sure if the mail was not opened at the lawyer's office or truely it arrived the very next day.
I think the best for you would be to schedule a Infopass and go there with your information. If they feel like helping you, they can have you fill the application form right there and issue the AP in a day or two.
Take a couple of your passport photos just in case they want you to fill the application again. It is a very short application. So it takes less than 10 minutes to fill it. They may not charge you any money. Just take your 485 receipt notice, I-140 approval notce, previous AP approvals if any, current EAD with you.

I had filed for my 6th year h1b extension without the lawyer , I did so bec the paper work was similar to my last extension ,and i saw that lots of people on the IV forum had Filed the H1b extension themselves.
Anyways, my human resource personal hired a new secretory and she some how misplaced my H1b receipt/possible RFE? , I have the EAC # from my cancel check ; when i check my status online it says case received and pending my PD is Jan08 ,2007 and the CSC is processing Jan. 13th, my question is if a RFE is issued will that be posted on the online case status website? I have asked the HR to request a duplicate copy from INS , should i also ask them to contact USCIS over the phone in addition to the written request?

My EB2 I-140 is also pending. RD for I-140 is 03-21-2007. I have sent two SR.

do we know how much it is for this year?
For FY2010 it was ~ 10K and it was mentioned some time back on USCIS website that the spillover for FY2011 may be similar. But I guess we won't know until an official announcement is made.
